Quick answer: The tax audit report for AY 2026-27 is due 21 October 2026 (extended from 30 September 2026), and the income tax return for the same audit cases is due 21 November 2026 (extended from 31 October 2026). The extension comes from CBDT Circular No. 07/2026 dated 28 September 2026. Transfer pricing cases are not covered — their dates stay 31 October (Form 3CEB) and 30 November (ITR).
What Changed: The New Dates
The Central Board of Direct Taxes (CBDT) issued Circular No. 07/2026 (F. No. 225/128/2026/ITA-II) on 28 September 2026, along with a press release the same day. It moved two deadlines for Assessment Year 2026-27, which covers income earned in FY 2025-26.
| What you file | Old deadline | New deadline |
|---|---|---|
| Tax audit report (Form 3CA/3CB + 3CD) | 30 September 2026 | 21 October 2026 |
| Income tax return for audit cases | 31 October 2026 | 21 November 2026 |
| Transfer pricing report (Form 3CEB) | 31 October 2026 | 31 October 2026 (unchanged) |
| ITR for transfer pricing cases | 30 November 2026 | 30 November 2026 (unchanged) |
The extension gives you 21 extra days to file the audit report. It does not give extra time to hold on to tax that is already due. Interest on unpaid tax can still run from the original due date — CBDT has not announced any waiver. If you expect to pay tax, pay it right away and use the extra days for the report, not for the money.
Why was the date moved? In the weeks before 30 September, CA associations and tax professionals had asked the government for more time, citing the workload of completing audits and reconciling financial and tax records. CBDT announced the extension two days before the original deadline.
Who Is Covered by the Extension
The extension is limited to the persons at S. No. 2 of the Table below Explanation 2 to Section 139(1) of the Income-tax Act, 1961, where Section 92E does not apply. In plain words:
- A company — any company whose accounts must be audited under the Income-tax Act or any other law.
- An assessee other than a company whose accounts must be audited under the Income-tax Act or any other law — for example, a business or professional who crosses the tax audit threshold.
- A partner of a firm whose accounts must be audited, including the spouse of such a partner where Section 5A applies (the Portuguese Civil Code, applicable in Goa).
If you fall in one of these three groups, the 21 October date applies to you. If your case involves transfer pricing (Section 92E), the old dates still apply.
One point about which law applies: this audit relates to FY 2025-26, so it runs under the Income-tax Act, 1961 (Section 44AB). The same audit provision is Section 63 in the new Income-tax Act, 2025, which applies to later years.
Which Forms: 3CA, 3CB and 3CD
Your Chartered Accountant (CA) files the audit report on the e-filing portal. The taxpayer must accept the report, and the CA generates a Unique Document Identification Number (UDIN). The three forms work together:
| Form | When to use it | What it contains |
|---|---|---|
| Form 3CA | Accounts already audited under another law (for example, the Companies Act) | Audit report prepared by the CA |
| Form 3CB | Accounts not audited under another law | Audit report prepared by the CA |
| Form 3CD | Filed with either 3CA or 3CB | Statement of particulars — turnover, expenses, tax deducted, and other details |
How filing works, step by step:
- The CA prepares the audit report under Section 44AB of the 1961 Act.
- The CA logs in to the Income Tax e-filing portal and uploads Form 3CA or Form 3CB together with Form 3CD.
- The taxpayer logs in, reviews the report, and accepts it.
- The CA signs the forms and generates the UDIN, which appears on the filed forms as proof of submission.
The only difference between Form 3CA and Form 3CB is whether the accounts are already audited under a different law. Both are filed with Form 3CD.
What Stays Unchanged: Transfer Pricing Cases
The circular makes it clear that transfer pricing cases are not covered by the 21 October extension. For those cases:
- The transfer pricing report in Form 3CEB must still be filed by 31 October 2026.
- The income tax return for the transfer pricing case must still be filed by 30 November 2026.
No extra time is granted here. Treat these dates as fixed.
What Happens If You Miss 21 October
Missing the 21 October deadline can attract a penalty under Section 271B of the Income-tax Act: one-half percent (0.5%) of total sales, turnover or gross receipts for the year, capped at ₹1,50,000 — whichever is lower.
Example: if your turnover is ₹3 crore, 0.5% of that is ₹1.5 lakh, which is the maximum penalty. If your turnover is ₹1 crore, 0.5% is ₹50,000, so the penalty would be ₹50,000.
Relief exists under Section 273B if you can show a reasonable cause for the delay. You must apply to the assessing officer with supporting documents — a genuine reason backed by evidence, not just a claim that you were busy.
On top of the penalty, interest under Section 234A can continue to accrue on any tax that remains unpaid. The extension only gives you more time to file the paperwork, not to postpone tax payment. A late audit report also delays your ITR, because the return figures must match the audited accounts.
One more thing to know: CBDT’s SAKSHAM NUDGE campaign sent SMS and email reminders to nearly 12,000 tax professionals who had filed less than 50% of their previous-year audit report count. More than 19.5 lakh audit reports had already been filed when the reminders went out. A reminder is not a new extension — the dates have not moved since Circular 07/2026.
What To Do Now: A Practical Checklist
For taxpayers:
- Confirm whether you belong to the covered group (company, non-company audit case, or partner/spouse).
- Collect all financial statements for FY 2025-26 and share them with your CA.
- Check that your CA is using the correct audit form (3CA or 3CB).
- Log in to the e-filing portal and accept the audit report once your CA uploads it — the filing is not complete until you accept.
- Check that the UDIN appears on the filed forms.
- Prepare your ITR using the audit details and file it by 21 November.
- Pay any tax due right away to limit interest.
- Do not rely on WhatsApp forwards about a further extension. Check the CBDT circular listing on the Income Tax website or the PIB release — as of 17 October 2026 there is no second extension.
For Chartered Accountants:
- Confirm each client’s eligibility for the extension.
- Complete the audit under Section 44AB and prepare Form 3CA or 3CB with Form 3CD.
- Upload the forms on the e-filing portal well before 21 October — do not wait for the last day, when the portal slows down.
- Send the acceptance link to the taxpayer and remind them to log in and accept.
- Obtain the UDIN and share a copy with the client.
- If you expect to miss the deadline for a client, document the reasonable cause now, so the client can seek relief under Section 273B.
Frequently Asked Questions
Did the tax audit deadline get extended again?
No. The deadline was moved once, from 30 September 2026 to 21 October 2026, by Circular No. 07/2026. The SAKSHAM NUDGE reminders are about that same extended deadline, not a new extension.
What is the ITR deadline for audit cases this year?
For the persons covered by the extension, the ITR must be filed by 21 November 2026. Do not use 31 October — that was the old date.
Who is covered by the 21 October extension?
Companies, non-company assessees whose accounts must be audited under the Income-tax Act or any other law, and partners (including spouses where Section 5A applies) of firms whose accounts must be audited — in all cases where Section 92E does not apply.
What happens if my CA misses the 21 October deadline?
A penalty under Section 271B may apply — 0.5% of turnover, capped at ₹1,50,000. The client can seek relief under Section 273B by showing reasonable cause. Interest under Section 234A can also continue on unpaid tax.
What is the difference between Form 3CA and Form 3CB?
Form 3CA is used when the accounts are already audited under another law, such as the Companies Act. Form 3CB is used when the accounts are not audited elsewhere. Both are filed together with Form 3CD.
Do transfer pricing cases get the new 21 October date?
No. Transfer pricing cases remain on the old schedule: Form 3CEB due 31 October 2026, ITR due 30 November 2026.
